The South Jakarta District Court (PN Jaksel) rejected the pretrial lawsuit against the alleged bribery and gratuity of the non-active Papua Governor Lukas Enembe.
“At trial, in the main case, stated rejecting the pretrial request in its entirety,” said Single Judge Hendra Utama Sutardodo in reading the verdict at the South Jakarta District Court, Wednesday.
The judge considered that the determination of the suspect by the Corruption Eradication Commission (KPK) against Lukas Enembe was in accordance with legal procedures.
Previously, Lukas Enembe filed a pretrial lawsuit at the South Jakarta District Court on Wednesday (29/3). Pretrial lawsuit with case number
29/Pid.Pra/2023/PN JKT.SEL is related to the validity of the KPK’s determination of the suspect Lukas Enembe.
In his petitum, Lukas Enembe asked the judge to declare the Investigation Warrant Number Sprin.Dik/81/DIK.00/01/09/2022, dated September 5, 2022 which designated him as a suspect in bribery and gratuities by the KPK to be illegal and had no legal basis.
Lukas Enembe also ordered the respondent (KPK) to issue a detention order by placing the applicant (Lukas Enembe) in a house/hospital and/or city detention with all the legal consequences.
During the pretrial hearing against Lukas Enembe’s lawsuit at the South Jakarta District Court on Tuesday (18/4), the KPK stated that the pretrial request for the Governor of Papua to be dismissed was premature and unclear or obscure (obscuur libel).
The KPK, represented by the Head of the Litigation and Witness Protection Section, the Coordinator of the KPK Legal Bureau Team, Iskandar Marwanto, asked the judges to reject all pretrial requests submitted by attorney Lukas Enembe.
“Rejecting the pretrial request submitted by the Petitioner (Lukas Enembe) as registered in the case register Number 29/Pid.Pra/2023/PN Jkt.Sel. or at least declaring the judicial request unacceptable,” said Iskandar.
Then, Lukas Enembe’s lawyer, Petrus Bala Pattyona, asked the panel of judges to reject all of the KPK’s exceptions which stated that Lukas Enembe’s pretrial request was premature and unclear or vague.
